Making a will is simple

Making a Will is not about wealth it is about making sure that what you want to happen to your estate does happen. It gives you the opportunity to specify such things as who will administer your estate, who will care for your children and who will receive specific items of your property.

Will in contemplation of marriage, estate to spouse with gift over to children of marriage, if any, and alternative gift of residue

I make this will in contemplation of my forthcoming marriage with and intend that it shall not be revoked by such marriage

  1. I hereby revoke all previous wills I have made
  2. Subject to payment of all my debts funeral and testamentary expenses I give all my estate to the said absolutely and appoint her sole executrix thereof and I intend that this gift shall take effect whether or not our marriage has been solemnised at the time of my death
  3. If the said should predecease me or the gift to her shall fail for any other reason than the following clauses shall apply
  4. I appoint my brother of and my sister of to be the executors and trustees of this my will (`my trustees')
  5. I give all my estate both real and personal whatsoever and wheresoever's to my trustees upon trust
    (a) to pay my debts funeral and testamentary expenses
    (b) to hold my residuary estate for any children of my marriage to who shall be living at my death and attain the age of 18 and if more than one in equal shares
    (c) in the event of there being no surviving children of our marriage or there being children who fail to live to 18 my trustees shall pay my residuary estate to such of my brothers and sisters as are living at my death and if more than one in equal shares
  6. I desire to be buried and authorise the cost of a memorial stone to be charged to my estate

IN WITNESS whereof I have signed this my will this day of [month year]. Signed by the said as his [Signature of testator] last will in the presence of us [Signature of first witness] both being present at the same [Name, address and occupation of time who at his request and in first witness] his presence and in the presence [Signature of second witness] of each other have hereunto [Name, address and occupation of signed our names as witnesses second witness]
